Marathon Law Announces First Colorado Civil Trial Win in Revenge Porn Case

We are proud to announce that we won Colorado’s first civil trial in a revenge porn case.

After a bench trial on claims alleging the defendant disclosed our client’s sex video without her consent, a Denver district court judge awarded our client nearly $40,000.00 in damages, attorney’s fees, costs and interest.

“We are pleased that our client was able to receive some measure of justice for the nonconsensual disclosure of her most private and intimate of images,” said Marathon Law founder and partner Jeff Dougan. “Typically, these types of cases settle out of court, so to take this one all the way to trial and win made this a special victory.”

In July 2019, Defendant, who was our client’s boyfriend at the time, broke into our client’s phone and stole a video of her engaged in sexual conduct with another man. Defendant then proceeded to send the stolen video to our client’s husband from whom she was separated.

“Colorado’s revenge porn law empowers victims and holds defendants accountable for exactly the kind of unacceptable behavior at issue here,” said Marathon Law partner Malissa Williams, “Our client has a right to control her own body and her own images. The defendant in this case took that autonomy away from her when he stole and distributed her video with her consent.”

Our client sued under Colorado’s Uniform Civil Remedies for the Unauthorized Disclosure of Intimate Images Act, which was passed by the Colorado General Assembly in 2019. Commonly referred to as Colorado’s “revenge porn” law, the statute allows victims to recover economic, noneconomic, and punitive damages, plus attorney fees and costs, if they have been harmed by the intentional or threatened disclosure of their private, intimate images. Injunctive relief for the removal and destruction of the images also is available.
